1. Who we are, and what this is
Mindset Prep is a study and exam-preparation app for ISO certification candidates. It is operated by Mindset Cyber Pty Ltd (ABN 55 668 364 261), an Australian company. These Terms govern your access to and use of the Mindset Prep marketing site (mindsetprep.com.au) and the Mindset Prep app (app.mindsetprep.com.au, plus our iOS and Android apps when published).
By creating an account, starting a free trial, or using the service in any other way, you agree to these Terms.
If you download our app from the Apple App Store or Google Play, your use of that app is also subject to that store's terms, including Apple's standard Licensed Application End User License Agreement. Where those store terms conflict with these Terms for the app you downloaded, the store terms prevail for that app.
2. Your account
- You must be at least 16 years old to use Mindset Prep.
- You are responsible for keeping your sign-in email and devices secure.
- One account, one person - accounts are not shareable across users.
- You are responsible for everything that happens under your account, including any conduct that violates these Terms.
3. The free trial
Mindset Prep offers a 3-day free trial. The trial requires a valid payment method on file at signup. We will not charge during the 3 trial days; the paid subscription begins automatically on day 4 unless you cancel before then.
On the web app, cancelling the trial is one click from Settings → Billing. If you started your trial through the Apple App Store or Google Play, the trial and any charge are handled by Apple or Google, and you cancel in your iPhone Settings → Apple ID → Subscriptions (or in Google Play). In every case, cancel any time before the trial ends and you will not be charged.
4. Subscription, billing, and renewal
- Pricing. Plans are billed monthly or annually in Australian dollars (AUD), and the price is shown at signup. We may change pricing for future billing periods with at least 30 days' notice; any change will only apply to your next renewal.
- Auto-renewal. Paid plans renew automatically at the end of each billing period until you cancel. For App Store and Google Play subscriptions, the subscription auto-renews unless auto-renew is turned off at least 24 hours before the end of the current period, and you are charged within 24 hours before the period ends. Cancellation takes effect at the end of the current paid period - you keep access to what you have already paid for.
- Payment processing. On the web app, card payments are handled by Stripe under their terms. In our iOS and Android apps, purchases are processed by Apple or Google as in-app purchases under their store terms, billed to your Apple ID or Google account.
- Managing your subscription. Web subscriptions are managed from Settings → Billing. App Store subscriptions are managed and cancelled in your iPhone Settings → Apple ID → Subscriptions; Google Play subscriptions are managed in Google Play.
- Failed payment. If a renewal payment fails, we will retry and notify you by email. If payment is not restored within seven days, the subscription will be paused.
5. Refunds and Australian Consumer Law
Our 3-day free trial is the period during which you decide whether the service suits you. After that, subscription fees are not generally refundable. We will, however, refund prorated amounts where required by Australian Consumer Law - including if the service has a major failure that we cannot remedy in a reasonable time.
If you purchased through the Apple App Store or Google Play, refunds for those purchases are handled by Apple or Google under their own policies, not by us. Your rights under the Australian Consumer Law still apply regardless of where you bought.
Nothing in these Terms excludes, restricts, or modifies any consumer right or guarantee you have under the Australian Consumer Law that cannot lawfully be excluded.
6. What you can and cannot do
You agree not to:
- Share your account or sublicense access. Each subscription is personal to one user.
- Scrape, mass-download, or republish the question bank, explanations, or any other content. Reasonable personal-study screenshots are fine.
- Use the service in a way that interferes with or imposes a disproportionate load on our infrastructure (including stress-testing, malicious automation, or denial-of-service patterns).
- Attempt to reverse-engineer the AI features in order to extract training data, prompts, or proprietary content.
- Use the service to break any law or violate anyone else's rights.
7. Intellectual property
The Mindset Prep brand, software, questions, explanations, illustrations, and AI-generated teaching content are owned by Mindset Cyber Pty Ltd (or licensed to us). Your subscription gives you a personal, non-transferable, non-exclusive licence to access and use them for your own exam preparation.
Public ISO/IEC standards remain the property of ISO and its national member bodies. We cite clause references for educational use; we do not redistribute the standards themselves.
8. AI features - what they are and are not
The Mindset Prep Tutor and Coach features are AI-generated study aids grounded in the cited clause text of the relevant standard. They are designed to help you understand and recall what an ISO standard says.
They are not legal, compliance, or audit advice. They are not a substitute for the official standard, the official course, or qualified professional judgement. We do our best to keep them accurate, but AI output can be wrong - always check anything material against the standard itself before acting on it.
9. No guarantee of exam result
Mindset Prep is a preparation tool. Passing or failing your exam depends on the work you put in, the exam provider's marking, and factors outside our control. We do not guarantee any particular exam outcome and we are not affiliated with PECB, CQI/IRCA, Exemplar Global, TRECCERT, BSI, or any other certification body referenced on the site.
10. Service availability and changes
We aim for high availability but we do not promise the service will be uninterrupted or error-free. From time to time we will release new features, change existing ones, or retire features that are not earning their keep. We will not remove anything material without reasonable notice.
11. Termination
- By you. Cancel any time - from Settings → Billing on the web, or from your iPhone Settings → Apple ID → Subscriptions (or Google Play) for an app-store subscription. You can delete your account any time from Settings → Account. Deleting your account does not by itself cancel an Apple or Google subscription, so cancel that separately in the relevant store to avoid being billed again.
- By us. We may suspend or close an account that violates these Terms, attacks the service, or operates fraudulently. Where we close an account because of a violation, no refund is owed.
12. Liability
Nothing in these Terms limits any non-excludable consumer guarantee under Australian Consumer Law, statutory rights, or our liability for fraud, death, or personal injury caused by our negligence.
To the maximum extent permitted by law, our total liability to you arising out of or in connection with the service in any 12-month period is limited to the amount you paid us for the service in that period. We are not liable for indirect or consequential loss, loss of profits, loss of data, or loss of opportunity.
13. Privacy
Our Privacy Policy explains what personal information we collect and how we handle it.
14. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or in-app before it takes effect. Continued use of the service after the effective date of an update means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we both submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
